Important Notice

This policy is provided for informational purposes and describes our procedures for handling copyright infringement claims. For legal advice regarding copyright matters, please consult with a qualified attorney.

Overview

NaijaRave ("we," "our," or "us") respects the intellectual property rights of others and is committed to complying with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws. We will respond to notices of alleged copyright infringement that comply with the DMCA and other applicable laws.

If you are a copyright owner or an agent thereof and believe that any content on NaijaRave infringes upon your copyrights, you may submit a notification pursuant to the DMCA by providing our designated copyright agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further details).

Filing a DMCA Takedown Notice

To file a valid DMCA takedown notice, you must provide the following information in writing:

  1. Physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material. Please provide specific URLs or links to the infringing content.
  4. Contact information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an email address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Our Response Process

Upon receipt of a valid DMCA takedown notice that substantially complies with the requirements above, we will:

  1. Review the notice to ensure it meets DMCA requirements
  2. Promptly remove or disable access to the allegedly infringing material
  3. Notify the user who posted the content about the takedown and provide them with your contact information
  4. Provide the user with an opportunity to submit a counter-notification if they believe the content was removed in error

We will make a good faith effort to contact the user who provided the allegedly infringing content so that they may make a counter-notification pursuant to sections 512(g)(2) and (3) of the DMCA.

Counter-Notification

If you believe that your content was removed in error or misidentification, you may file a counter-notification. To be effective, a counter-notification must be a written communication provided to our copyright agent that includes substantially the following:

  1. Your physical or electronic signature (or of the person authorized to act on your behalf)
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which NaijaRave may be found), and that you will accept service of process from the person who provided notification under subsection (c)(1)(C) or an agent of such person

Warning: Submitting a false counter-notification may result in legal consequences. Only submit a counter-notification if you genuinely believe the content was removed in error.

Repeat Infringers

It is our policy to terminate, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also at our sole discretion limit access to NaijaRave and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

False Claims

Please note that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability. Similarly, any person who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification may be subject to liability.

Important: Only submit a DMCA takedown notice if you are the copyright owner or authorized to act on behalf of the copyright owner. False or fraudulent claims may result in legal action against you.
